Terms of Service
Effective date: 21 May 2026
These Terms of Service ("Terms") form a binding agreement between you and PlantTogether ("PlantTogether", "we", "us") and govern your access to and use of the PlantTogether website, mobile experience, and related services (the "Platform"). By creating an account or using the Platform, you agree to these Terms.
These Terms are governed by the laws of the Federal Republic of Nigeria.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By using the Platform you confirm you have the legal capacity to enter into these Terms.
2. Accounts
- Provide accurate, current information when registering.
- Keep your password and credentials confidential. You are responsible for activity under your account.
- Notify us immediately at support@planttogether.org of any unauthorised use.
- We may suspend or terminate accounts that violate these Terms or applicable law.
3. Roles on the Platform
3.1 Sponsors and Co-sponsors
Sponsors fund trees and campaigns. Co-sponsors contribute to existing campaigns. Sponsorships are charitable contributions to long-term restoration work and are not investments and do not confer ownership of land or trees.
3.2 Custodians
Custodians are verified local stewards who plant and care for assigned trees. Custodians agree to:
- Provide truthful identity and location information during verification.
- Plant trees at the agreed locations and submit honest, timely reports (photos, GPS, health updates).
- Use TreeCare Packs and resources only for the trees they are assigned.
- Avoid any form of fraudulent reporting, double-planting, or misuse of funds.
3.3 NGO administrators
Administrators coordinate operations, verify custodians, and review reports. Admins must act in good faith and protect data they access on the Platform.
4. Sponsorships, campaigns, and payments
- Prices are shown in the currency displayed at checkout and include applicable taxes where required.
- Payments are processed by third-party payment providers; their terms also apply.
- Once a sponsorship is allocated to a tree or campaign, it is generally non-refundable, except where required by Nigerian consumer-protection law or where we are unable to fulfil the sponsorship within a reasonable time.
- If a planted tree dies within the survival window, we will replant or reassign an equivalent tree at no extra cost to the sponsor.
- Campaign organisers may not redirect collected funds for purposes other than the stated campaign goal.
5. Content and licence
You retain ownership of content you submit (photos, dedications, reports). By submitting content, you grant PlantTogether a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and adapt that content for the purposes of operating, promoting, and reporting on the Platform and its environmental impact. You confirm you have the rights to grant this licence and that your content does not infringe third-party rights.
6. Acceptable use
You agree not to:
- Use the Platform for any unlawful purpose or in breach of Nigerian law.
- Submit false reports, manipulate GPS data, or misrepresent tree status.
- Upload content that is defamatory, obscene, hateful, or infringes any right.
- Attempt to gain unauthorised access to the Platform, other accounts, or our infrastructure.
- Use the Platform to harass other users, custodians, or staff.
- Scrape, reverse-engineer, or interfere with the Platform's operation.
7. Verification and moderation
We may verify custodian identity, review uploads, and remove content or accounts that breach these Terms. Verification does not constitute a guarantee of any user's conduct.
8. Intellectual property
The Platform — including its name, logo, design, software, and aggregated content — is owned by PlantTogether or its licensors and protected by applicable IP laws. Except for the rights expressly granted in these Terms, no licence is granted to you.
9. Third-party services
The Platform integrates with third-party services (e.g. Google sign-in, Google Maps, payment processors, cloud hosting). Your use of those services is subject to their own terms; we are not responsible for their content or practices.
10. Disclaimers
The Platform is provided on an "as is" and "as available" basis. While we work hard to deliver accurate impact data and reliable stewardship, we do not warrant that the Platform will be uninterrupted, error-free, or that every tree will survive. Environmental outcomes depend on weather, soil, community factors, and other variables outside our control.
11. Limitation of liability
To the maximum extent permitted by Nigerian law, PlantTogether's total liability arising out of or related to these Terms or the Platform is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) NGN 50,000. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or expected impact.
Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.
12. Indemnity
You agree to indemnify and hold PlantTogether harmless from any claim, loss, or expense arising from (a) your breach of these Terms, (b) your content, or (c) your violation of any law or third-party right.
13. Termination
You may close your account at any time from your profile settings. We may suspend or terminate your access if you breach these Terms, attempt fraud, or where required by law. Sections that by their nature should survive termination (e.g. IP, liability, governing law) will survive.
14. Privacy
Our handling of personal data is described in our Privacy Policy, which is issued in compliance with the Nigeria Data Protection Act, 2023 and the NDPR.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the Platform or by email at least 14 days before they take effect. Continued use of the Platform after the changes take effect constitutes acceptance of the updated Terms.
16. Governing law and dispute resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. The parties will first attempt to resolve any dispute amicably. If unresolved within 30 days, the dispute will be referred to arbitration in Lagos, Nigeria, under the Arbitration and Mediation Act, 2023, by a sole arbitrator appointed by the parties. The courts of Lagos State retain exclusive jurisdiction for any non-arbitrable matters.
